    In the name of God amen I James McCuistion of the province of North Carolinia and County of Rowan being in Infirm in body but of Sound Memory and Judgement do this Eighteenth day of October In the year of our lord God One thousand Seven hundred and Sixty five Make & publish this my Last will and Testament whither by word or writing if Such be made By me first I bequith my Soul to God Waiting Through Grace in Christ My Savour for that Merit promised to them that Believe in him, and My Body to Be Intered as my Executor Thinks fit. and first of all to pay my Just Debts and to Divide my Estate as follows to wit

    First of all I give to my Dearly Beloved wife Jenut McCuistion the full [?] part of all my Movables with my Ready Money and Debts Due to me with my Negro, fellow Named Jim, or James. Secondly with my plantation I now live on During her life time not to be Disturbed By any to have the Same power as if I was alive …….

    Secondly, I Give the remainder of all my movables and Chattle To my five Daughters to be Equally Divided among [?] To my Daughter Jane now mary’d To Thomas Flack also, to my Daughter Sarah also, to my Daughter Lovina now mary’d to John Nelson also to my Daughter Mary and to my Daughter Dorcas —

    Thirdly I give my son Gustavus McCuistion [?] give Four Hundred & forty Acres of Land Lying on Both Sides of [Richland Creek?] Known by the name of The Mill place joining Scotsland. I allow and ordain Son Thomas McCuistion as Guardein over him and not to sell or [?] of the plantation I left to my Son Gustavus McCuistion without my son Tho’s McCuistions concent or leave Now By the name of the Mill [?] ………..

    Fourthly I Give to my son James McCuistion the plantation I now live on with all the Improvements and piece or parcle of land as is Contain’d In [?] for [?] Improvement, at his Mother My Wife’s Death and not to then and not molest her or any she apoints to live on it During her lifetime.

    5th I allow Unto My Son Tho’s McCuistion the sum of Twenty shill. Current money of North Carolina to be paid in three months after my decease to be paid By my Son James McCuistion.

    6ly I allow unto Son Tho’s McCuistions Son James McCuistion the sum of Nine pounds to be paid when he is Come of age By my son James McCuistion.

    7 Also I allow my Son James McCuistion to pay unto my three daughters Sara, Docas, & Mary each of them Twenty pounds to be paid in four years after their Mothers Deceas My wife Jennet McCuistion and my Son Tho's McCuistion & my son James McCuistion Executor of this my last will & Testament in the presence of who were present at the signing & sealing Thereof the day & year above written
